Last Will.  Needed for the orderly flow of your assets to the next generation and closing of your affairs; especially to avoid consequences that you would have never expected or wanted.

Durable Power of Attorney.  Vital if you were ever to become incapacitated, even temporarily; alternative is expensive and emotionally devastating court proceedings.

Trust.  Often interpreted in ways you would have never expected, but important if:

• You want to avoid 'probate', especially the uncertainties and delays that come with probate these days.
• You own real estate in more than one state;
• Your heirs or executors all live out of state;
• You are in a second or third marriage;
• You have a beneficiary with special needs or special troubles;
• Your assets are in excess of five million dollars.

Not a good idea!  These are really important documents.  You want the documents  to 'work' at the most critical time of your life - and later.   More than that, you want your heirs to be guided by professionals who are knowledgeable but reasonable and whom you know -- and, most often, to whom you have been referred by other trusted friends, family members, and professionals.
